Acceptance of Terms
By downloading, installing, or using PizzaApp Pro (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
License Grant
Subject to your compliance with these Terms, the developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.
Apple App Store Additional Terms
If you obtained the App from Apple's App Store, the following additional terms apply and take precedence over any conflicting terms in this document:
- This license is granted to you only, and not to Apple. Apple is not a party to these Terms and is not responsible for the App or its content.
- Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
- Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
Google Play Additional Terms
If you obtained the App from Google Play, your use of the App is also subject to the then-current Google Play Terms of Service. Google is not responsible for the App or its content and has no obligation to provide support or maintenance.
Acceptable Use
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the App, or reverse engineer or attempt to extract the source code of the App, except where such restriction is prohibited by applicable law.
- Use the App for any unlawful purpose or in violation of any applicable local, national, or international law or regulation.
- Interfere with or disrupt the integrity or performance of the App.
Purchases and Donations
The App may offer optional in-app purchases or voluntary donations (e.g. "Buy me a Pizza"). All purchases are processed by the applicable platform (Google Play, Apple App Store, Stripe, or Ko-fi) and are subject to that platform's payment and refund terms. Donations are non-refundable except as required by applicable law or the platform's own refund policy.
Advertising
The App may display advertising served by third-party advertising networks, including Google AdMob. Where required by applicable law, you will be asked for consent before personalized advertising is shown.
Recipe and Dough Calculations Disclaimer
The App provides pizza dough recipes, hydration, fermentation, and baking calculations for informational purposes only. These calculations are estimates based on general baking principles and are not a guarantee of any particular result. You are solely responsible for food safety, including proper handling, proofing, and baking temperatures and times. The developer is not liable for any spoiled ingredients, failed bakes, or health issues arising from use of the App's recipes or calculations.
Disclaimer of Warranties
To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Nothing in these Terms limits liability that cannot be excluded or limited under applicable law.
Changes to These Terms
The developer may update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance of the revised Terms. The effective date at the top of this document indicates when it was last updated.
Governing Law
These Terms are governed by the laws of Germany, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence provide otherwise.
